Weapons Ban Restraining Order Will Remain in Place

(Undated) — A temporary restraining order partially blocking Illinois’ new assault weapons ban will remain in place. Illinois’s 5th District Appellate Court agreed with Effingham County Circuit Judge, Joshua Morrison’s, ruling that the ban likely violated the state’s constitution. The ban is temporarily blocked from being enforced on more than 800 plaintiffs in a lawsuit challenging the new law. The ruling means that the state is prevented from enforcing the law against the named plaintiffs in the case. The decision is expected to be appealed to the Illinois Supreme Court. A hearing on the lawsuit is still scheduled for today in Effingham County.
